Job Presentation
  • The Commercial Manager (CM) oversees the management and monitoring of the legal activities of JNSHC in accordance with the provisions of the established Quality Management System, Concession Agreement and Schedule associated with the North South Highway, the Jamaican Laws as well as any other applicable standards and regulations. The incumbent is responsible for Contract Management, Suppliers Management, Procurement, Claims Management, Importation, Marketing & Public Relations and Legal Affairs. The Commercial Manager is also responsible for keeping the company abreast of national and international laws to ensure that the relevant laws and guidelines are followed to avoid conflicts. The incumbent is required to liaise with the Attorney who shall provide legal support for the company in court, with government and other external stakeholders and to execute transactions on the company’s behalf.


Responsibilities
PRINCIPAL RESPONSIBILITIES/ACCOUNTABILITIES
  • To setup the management system and to preside over and /or manage the daily work of the Commercial Section and to coordinate and handle the daily affairs with the other departments concerned.
  • To organize and conduct meetings about the commercial and contract management and to know well the implementation status of the commercial affairs and contract management of the Company.
  • Be responsible for checking or reviewing the payment requisitions submitted by suppliers as per the signed contract as well as the approval of purchase orders.
  • To control the risk of the Company, and to hold the meeting on the subject of risk control and to streamline the risk controlling measures.
  • Be responsible for the work variation and work claims of the Company and to settle any contract dispute and protect the interests of the Company.
  • Be responsible for the organization of tender preparation and procurement works.
  • Oversee the management of the insurance policies of the Company and the claims associated with the Company’s insurance policies.
  • Oversee the handling of the claims of the road operation accidents (both against JNSHC and against the third parties).
  • To organize the analysis and comparison of prices offered by the suppliers so as to control the contract cost.
  • To participate in the formulation of a cost control plan and to control the managerial cost and operating cost of the Company as required.
  • To host the contractual inspection performed by the supplier(s).
  • To prepare the monthly statement of the Section for submission.
  • To remain in contact with the Company’s headquarters and other relevant units.
  • Ensure that contracts and other legal documents are reviewed and checked within the company’s internal policy and complete all necessary review procedures.
  • To organize contract negotiations as well as to be responsible for the connection with the relevant parties.
  • To review the minutes taken during contract discussions and meetings.
  • To participate in the inspection of contract performance by contractor(s).
  • Be responsible for reviewing and checking the contractual payment application submitted by the contractor and to give a preliminary comment.
  • Manage and maintain the filing system for commercial documents.
  • To perform the managerial works of the contract documents for the company, mainly on monitoring the contractor’s contract(s), and to know well the implementation status of the contract performance by the contractors.
  • To participate in the works variation or change and works claim in connection with the contracts.
  • Be responsible for handling the daily legal affairs for the company and to collect the relevant legal documents so as to provide legal support for the contract performance and to assist the company in handling claims disputes.
  • To oversee the collection, sorting, filing of contracts and agreement records and data as well as to update all contractual information from time to time.
  • Handles the business for secondary development of the company including contractual negotiation and preparation of documentations.
  • Collect and protect all legal documents of the company.
  • Prepare all legal documents as required by the court and attend court as requested by the company.
  • To keep the connection with the Companies Office of Jamaica and the secretary company of Barbados and is responsible for the Documentation Registration, including the Company’s Directors and Secretary with the Companies Office of Jamaica.
  • To manage all correspondences on commercial affairs on behalf of the company to all parties concerned.
  • Be responsible for processing the formalities of the insurance and/or to be insured with local insurer, including renewal, tracking and claiming work on behalf of the company and to participate in the management of other insurances as required.
  • Be responsible for the work order and purchase order documents review and/or check within the company and to complete all necessary review procedures.
  • Liaise with the Attorney-at-Law regarding claims, major contractual agreements and other legal affairs.
  • Manage customs clearance for imported goods by preparing and processing import documentation according to customs regulations, laws and procedures.
  • Liaise with the Finance Department for payment of charges to clear imported goods for the company.
  • Advising the company about changes in import restrictions, tariff system, insurance requirements and other custom related matters to the company and be responsible for the customs clearance for any imported materials, goods and facilities from the abroad.
  • Ensure legality of transactions and advise the company on legal rights and duties.
  • Be responsible for the price enquiry for the materials and the equipment rental from the local construction market and updating all relevant information as required by the company.
  • Cost Control-Monitors the Commercial Section’s annual budget and ensure that the Section assists the Company in cost saving.
  • To manage the procurement process and the negotiations of the new contract to be signed;
  • To make recommendations through the analysis and comparison of quotations for cost control on procurements.
  • Prepare monthly reports for the Commercial Section.
  • Provide commercial and legal support to other Department/Section Managers in the execution of contracts, documents and other legal matters.
  • Supervises the Assistant Commercial Officer, Commercial Officer and Marketing and Public Relations Officer.
  • Organize and conduct customer satisfaction surveys (internal and external). Prepare their analyses and report on the customer satisfaction levels with the Marketing and Public Relations Officer.
  • Overseas or collaborate on all company related Public Relations and Marketing initiatives.
  • Identifies the need for training on matters relating to the legal, customs laws/tariff laws and other relevant commercial practices (training may be done by in-house personnel or external) and makes the necessary arrangements for its facilitation.
  • To be responsible for the Seal of the Commercial Section and maintain a log of the Seal’s usage; and
  • To handle any work from time to time as required to be done by the top management of the Company.
DECISION MAKING AUTHORITY
  • Assists the Managing Director in making the best decisions for the Commercial Section.
PHYSICAL/VISUAL/MENTAL DEMANDS & WORKING ENVIRONMENT
  • This job may involve a length of time in the outdoors, at times in the sun, and walking along the motorway during site visits and inspections. Otherwise, the Commercial Manager’s job duties involve light physical demands (sitting, walking and standing).
  • Be able to operate in a demanding work environment that requires a high level of precision and multi-tasking.
  • Strong organizational skills
The incumbent is based in an office at the Management Centre.TYPICAL WORKING TIME
  • 08:00 – 17:00, from Mondays to Fridays
